Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of JuJu Paranormal Pursuit mobile application, website, and related services (collectively, the "Service") provided by Banly's, LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

Acceptance of Terms

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Banly's, LLC. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

Age Restrictions

The Service is not intended for children under 13 years of age (or 16 in the European Union). By using the Service, you represent and warrant that:

• •You are at least 13 years old (or 16 in the EU), or you have parental consent and supervision
• •You have the legal capacity to enter into these Terms
• •Your use of the Service does not violate any applicable law or regulation

Use License

We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

User Conduct and Prohibited Uses

You agree not to use the Service in any way that:

• •Violates any applicable law, regulation, or third-party right
• •Infringes upon intellectual property rights or proprietary rights of others
• •Is harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• •Involves trespassing on private property without permission
• •Endangers yourself or others, including using the Service while driving or operating machinery
• •Attempts to gain unauthorized access to our systems or networks
• •Interferes with or disrupts the Service or servers connected to the Service
• •Uses automated systems (bots, scrapers) to access the Service
• •Impersonates any person or entity or misrepresents your affiliation

Prohibited Technical Activities:

• •Copy, modify, adapt, translate, or create derivative works of the Service
• •Reverse engineer, decompile, disassemble, or attempt to extract source code
• •Remove, alter, or obscure any copyright, trademark, or proprietary notices
• •Rent, lease, sublicense, or transfer the Service to any third party
• •Use the Service for commercial purposes without our written permission

User Content and Intellectual Property

Your Content: You retain ownership of all content you create, upload, or submit using the Service (including photos, videos, EVP recordings, investigation notes, and other materials) ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:

• •Use, store, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service
• •Use anonymized, aggregated data derived from User Content for research and analytics purposes (if you opt-in to anonymous data collection)

Our Intellectual Property: The Service, including all software, designs, text, graphics, logos, trademarks, and other content, is owned by Banly's, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. JuJu™, Estep Loop™, and Ghost in the Box™ are trademarks of Banly's, LLC. You may not use our trademarks or intellectual property without our prior written consent.

User Content Representations: You represent and warrant that your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights, and that you have all necessary rights and permissions to grant us the license described above.

Subscriptions and Payments

The Service offers subscription tiers (Pro, Pro+, Lifetime) that provide additional features and storage. By purchasing a subscription, you agree to the following:

• •Payment: Subscription fees are charged through the App Store or Google Play Store. You agree to pay all fees associated with your subscription.
• •Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions in your device's app store settings.
• •Price Changes: We reserve the right to change subscription prices. We will notify you of price changes, and you may cancel your subscription before the change takes effect.
• •Refunds: Refunds are handled by the App Store or Google Play Store in accordance with their refund policies. We do not provide direct refunds.
• •Cancellation: You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.
• •Lifetime Access: Lifetime subscriptions grant access for the lifetime of the Service. If the Service is discontinued, lifetime subscribers will be notified and may be offered alternative arrangements.

Safety and Liability Disclaimer

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BANLY'S, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• •Loss of profits, revenue, data, or use
• •Personal injury or property damage resulting from use of the Service
• •Any damages arising from reliance on the Service for safety-critical purposes
• •Any damages resulting from trespassing or illegal use of the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• •WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• •WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• •WARRANTIES THAT THE SERVICE CAN DETECT, IDENTIFY, OR PROVE PARANORMAL ACTIVITY
• •WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR USEFULNESS OF ANY READINGS, DETECTIONS, OR ANALYSIS PROVIDED BY THE SERVICE

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED. THE SERVICE IS PROVIDED FOR ENTERTAINMENT PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR ANY SERIOUS OR SAFETY-CRITICAL PURPOSE.

Indemnification

You agree to indemnify, defend, and hold harmless Banly's, LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys' fees) arising from: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; (d) your User Content; or (e) any injury, death, or property damage resulting from your use of the Service, including but not limited to trespassing, illegal activities, or use in unsafe situations.

Termination

Termination by You: You may stop using the Service at any time. You may delete your account by contacting us at privacy@jujuparanormal.com. Upon account deletion, your access to the Service will be terminated, and we will delete your personal data in accordance with our Privacy Policy.

Termination by Us: We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• •Violation of these Terms
• •Fraudulent, illegal, or harmful activity
• •Extended periods of inactivity
• •Requests by law enforcement or government agencies
• •Discontinuation or material modification of the Service

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at legal@jujuparanormal.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

Binding Arbitration: If we cannot resolve a dispute informally, you and Banly's, LLC agree to resolve any disputes arising out of or relating to these Terms or the Service through final and binding arbitration, except as set forth below. The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Exceptions: Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Service, or intellectual property infringement, without first engaging in arbitration.

Class Action Waiver: You agree that disputes will be resolved individually and that you will not bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• •Posting the updated Terms on this page with a new "Last updated" date
• •Sending you an email notification (if you have provided an email address)
• •Displaying a notice in the Service

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may delete your account.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Texas, and you hereby consent to the personal jurisdiction and venue of such courts.

If you are located outside the United States, you agree that you are responsible for compliance with local laws in your jurisdiction. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Severability and Entire Agreement

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Banly's, LLC regarding the Service and supersede all prior agreements and understandings, whether written or oral.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Banly's, LLC.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, labor dispute, government action, internet or telecommunications failure, or other causes which are beyond our reasonable control.
